Andrew Marks and London McDaniels claim Common took part of their song "When Will the Day Come" and used it in his own track "Take it EZ." They are noting that they weren't paid properly for the use of the song. However, Common doesn't deny that he sampled their work.

As a matter of fact, Common acknowledges that he used a piece of their work. In the downloadable version that is available online, Com chose to add a tag line to inform fans of this. "Contains samples from 'When Will the Day Come'" can be read on the online listing of the track, according to TMZ.com.

Still, Marks and McDaniels have filed a lawsuit for unspecified damages against the Chicago representative. They claim Com never obtained proper authorization to use their work.

Common has been focusing on film lately. He is rumored to be involved in the upcoming A-Team film and has been said to be The Green Lantern in the Justice League film that may be released sometime in 2011. The Internet Movie Database [click here] also notes that Common is tied to Just Wright, a film with Queen Latifah and Date Night, a movie that features Mark Wahlberg, Mila Kunis, Tina Fey and Taraji P. Henson. Both films should be due out in 2010.

Universal Picture has announced that the film formerly titled Cirque du Freak has now been renamed The Vampire's Assistant and will be released on October 23.

The film stars John C. Reilly, Ken Watanabe, Chris Massoglia, Josh Hutcherson, Patrick Fugit, Ray Stevenson, Michael Cerveris, Frankie Faison, Jane Krakowski, Orlando Jones, Kristen Schaal and Salma Hayek. Paul Weitz directed from a script he co-wrote with Brian Helgeland. The studio also released a new synopsis for the film, which you can read below:

On January 15, 2009, a song called "Places" was added to the database of BMI, written by Aly & AJ, co-writing with Daniel James (Ryan Cabrera, Ashley Tisdale) and Leah Haywood (Rihanna, Ryan Cabrera, Ashley Tisdale). Aly & AJ are expected to release their new single from their upcoming album in the summer of 2009, and the album in the fall. The girls have also worked with Chris Lord-Alge (Green Day, AFI, Sum 41) and Rob Cavallo (Green Day, the Goo Goo Dolls, Paramore), both producers in the rock genre. On June 10, 2009, three extra song titles were announced from the upcoming album; being "Lovesick", "Bullet", and "The Edge". All three songs were written by Aly & AJ, Leah Haywood and Daniel James. On June 28, 2009, the duo revealed and confirmed four song titles via their official twitter account; being "Say Hello," "Damaged" (co-written with Nancy Wilson of Heart), "Civilian" and "Next Worst Thing."

I spoke with a family representative and confirmed that Mischa Barton was taken to the hospital due to complications from oral surgery.

Contrary to the gossip that has been tweeted by the LA Police and Access Hollywood, Mischa was simply in too much pain to drive and asked to be taken by the police so hoping the Paparazzi would leave her alone.


The surgery involved deep impacted teeth that had to be removed from her jaw bones. Her family is with her and she is being treated with antibiotics.

On Friday night, I went to see “Bruno.” I laughed. (Hardest at the part where Bruno goes camping with a bunch of rednecks and, as they sit around the campfire, he asks them which “Sex and the City” character they are.) I cried. (When Bruno’s velcro suit caused chaos at a fashion show, and he’s shunned by the entire Austrian fashion community.) I squirmed uncomfortably in my seat. (When a mom agrees that her 4-year-old would have liposuction in order to land a modeling gig. And again when Bruno crashes a swinger’s party and is repeatedly whipped by a woman with nipple rings. Now that I think about it, at least 40% of the scenes in the movie were squirm-worthy.) But as I left the theater, one big question kept running through my mind—how does Sacha Baron Cohen get away with these stunts without getting sued a hundred times a day?
 

Back during “Da Ali G Show” days, things were much simpler. Sacha Baron Cohen would send out interview requests under the guise of being a British production company called United World Productions. When interview subjects arrived, they were greeted by a clean cut, legitimate-looking director. It wasn’t until the red light on the camera blinked that Sacha Baron Cohen made his appearance.
 

Things got a little more complicated for “Borat.” Producers focused scenes in rural areas, where not nearly so many people have cable television. When producers pre-interviewed subjects, they threw in questions to make sure that they’d never heard of Ali G or Borat or Sacha Baron Cohen. The producers would give all subjects a release form which, conveniently, didn’t identify where the footage would be appearing. Often times, they’d hand out release forms en masse. “We’d have someone in the lobby of a hotel with release forms,” director Larry Charles told Squidoo. “We’d tell people we were shooting today and they may be in the background of a shot. Then they’d get in the elevator and, boom, two naked guys would come running in.” Most people were so quick to sign the forms that they didn’t notice any irregularities. The crew also had a lawyer who they ran through all their plans with. The lawyer helped determine the line between okay and way too much.
